Judicializing Environmental Politics? China's Procurator-led Public Interest Litigation against the Government

Abstract Scholars consider deficient local accountability mechanisms a key shortcoming of China's response to environmental issues. Through empirical analysis the new procurator-led public interest litigation (PIL) system, this study examines whether – and what extent can be remedied by empowering juridical institutions. It concludes that thanks procuratorates’ political insider status, relative autonomy from politics extensive resources, procurators have generally found ways maintain delicate balance between holding executive agencies environmentally accountable managing governments’ resistance PIL system.
